2023.03.24 16:59 davidloveasarson Received a pre-arbitration email from Ford for 2013 focus. Offered $3k cash. What would you do?

As the title says… got an email from a rep at Ford with like 13 questions about my 2013 focus in regards to the faulty transmission and repairs. I bought it used 2015 in Idaho. Have had TCM repairs and a couple new clutches put in. Car now has 140k miles so no more free transmission repairs and of course the big shudder is back. We have learned to just gun it from a stop to not shake much. Anyway, the email says it’s a pre-arbitration resolution due to the class action settlement. I sent in the info and one question asked what I wanted from Ford. I asked for 1 transmission repaireplacement at the dealer + $5,000 cash. I knew they’d probably counter. He reviewed my info and said according to it I don’t qualify under the Idaho lemon law for a buyback. I didn’t think it would qualify for that. He did offer me a $3,000 cash settlement and I get to keep my car. Here’s the wording used in the email and what I have to sign:
“Acceptance of this good faith cash settlement offer will close this pre-arbitration claim.
Please be aware that if goodwill offer is declined and you move on to arbitration as is your right, all offers made prior to arbitration are then voided and no longer available.”
“- I may be entitled to additional benefits by virtue of a class action Settlement in Vargas v. Ford Motor Company,

What would you guys do? I have 3 business days to accept or decline. I want to write back and say I’m not accepting or declining but would like $5,000 cash. What would my transmission cost to fix outside of warranty?
I’m leery of $3k, thinking just 1 repair might cost that. At the same time, the settlement seems to only show I’ll get like $400 for prior repairs so it seems like a good deal. Will this automatically send me to arbitration afterward? If so, seems like a no brainer to accept. But if this will cancel it then I’m not sure. Will I still get the class action settlement of a few hundred?
What would you guys do? Has anyone else done this yet?
My dad thought I should take it and call a regular transmission shop to get a repair quote. Or else just save it for a new car when this thing blows up.

If anyone is to blame for all of this, it’s Kerouac.
Sarah and I met in a class studying literature and film of the Great American Road Ttrip. She needed a course to keep her work-study job, and I needed a few credits to stay on pace to graduate. Sounded easy…read some books, watch a few movies, no sweat.
It wasn’t challenging, but it was engaging. The small group of us read Krakauer and Pirsig, watched Easy Rider and Thelma and Louise, and of course dove headfirst into the ultimate road trip, Kerouac’s On The Road.
The discussions lasted for hours. Most of us would meet up after class at a campus bar to continue exploring our thoughts on freedom, experience, risk, discovery. Sarah loved those sessions, and she would often jump in with an easy smile and eyes so intensely bright. She spoke often about the optimism of the Unknown, as she called it. I was smitten.
It didn’t take long for Sarah and I to do what college kids do, and we lost ourselves to it. We dove in fully. Boundaries disappeared. Inhibitions released. Like truly living for the first time.
After a month together we began our own road trip, a foray into the Unknown. Sarah wrote down route numbers and letters on scraps of paper and put them in a bowl. I picked one. 126e. That was the highway we took out of town. We threw clothes and sleeping bags in my trunk and went.
The first weeks were amazing. Freeing. No plans, no schedules. If we felt a pull in a direction, we went. We camped in beautiful places, gazed into the Milky Way at night, and spoke about everything endlessly. I’d never felt so in sync with someone.
But we ran out of money and gas in Ashton, Idaho. We were stuck and hungry. I wanted to call home for help, but Sarah…she couldn’t give up on the Unknown. Her eyes shone intently as she convinced me going back wasn’t an option.
Ashton is small. Super small. We sought cash jobs, but the town was wary of us. Hunger got to us. One night I broke into a hamburger joint for food, but the owner was there. He’d rejected my plea for work the day before, and when he pulled a gun that night…I went to the Unknown. It provided food and a way out.
Sarah convinced me we had to trust in it. She threatened to turn me in if I tried to leave. I had no choice but to stay on the road.
Months have passed. Nights are colder now. Darker. I can’t keep doing…these things. I want to go home.
Sarah stirs in her sleep. I touch her neck. I look into the clear night sky, into the Milky Way shining bright. The Unknown. Just one last time.
Let’s go home, Jack.

CARB rejects petition to ban fumigant
The Air Resources Board has denied a petition by environmental groups to phase out sulfuryl fluoride, a fumigant used in homes and food processing plants.
Californians for Pesticide Reform and the Center for Biological Diversity charged that the pesticide is a potent greenhouse gas. But CARB found the petition lacked data connecting the pesticide to a climate impact. The agency also worried about alternatives to the pesticide, potential economic impacts and a rise in termites in homes.
Rice commission seeks drought flexibility
State statute requires members of the California Rice Commission to be actively farming, even when half of the state’s rice fields go fallow. Now lawmakers are seeking more flexibility to ensure the commission represents all farmers.
The Assembly Ag Committee has approved a measure that would override the restriction during a drought emergency. Commission CEO Tim Johnson explained that the east side of the Sacramento Valley had a crop close to normal, while the west had almost no rice. Half of the valley now gets 80% of the votes, the rest only three seats.
Research could resolve tension in wine industry
A new bill is requesting $5 million to fund research into smoke taint in wine grapes.
The issue came to a head in 2020, when smoke taint led to $3.7 billion in losses. State, federal and private funding has since poured into research, but more is needed to identify the compounds and mitigate the impacts.
Tim Schmelzer, vice president of state relations at the Wine Institute, described it as a desperate need for research. He noted that smoke taint has created tension between growers and vintners due to testing constraints.
Jackson Gualco, a lobbyist for winegrape growers, warned that the issue could create a stigma that a prized California product has less than full integrity.
Feds award first of $1B in community wildfire grants
The Biden administration on Monday awarded $197 million in grants to help 22 states and seven tribes prepare for the coming wildfire season.
The funding will boost firefighter housing and pay, treat fuels on federal forest lands and help manage fires, with a focus on low-income communities and tribes. The grants are the first from a new $1 billion community protection program that stems from $7 billion in wildfire funds from the Infrastructure Investment and Jobs Act and Inflation Reduction Act.
The 100 projects in the initial round will also help high-risk communities, nonprofit organizations and state forestry agencies establish protection plans and educate homeowners on prevention practices like cleaning roof gutters and clearing vegetation.

WOTUS ruling sparks divided response
A decision from a federal judge in Texas halting the implementation of WOTUS in Texas and Idaho prompted diverse reactions, even within the ag community.
The American Farm Bureau Federation cheered the injunction, the only one to be issued among a handful of lawsuits challenging the Biden administration rule, which went into effect Monday. AFBF President Zippy Duvall said the judge’s ruling “undermines the [EPA and Army Corps of Engineers’] rationale for pushing through this new rule before the Supreme Court rules in Sackett v. EPA.”
The National Cattlemen’s Beef Association, however, emphasized the fact that the rule would remain in effect in 48 states.
“While we appreciate the court’s injunction of the rule in Texas and Idaho, we are strongly disappointed in the decision to keep this WOTUS rule in place in 48 states,” said NCBA President Todd Wilkinson, a South Dakota cattle producer.
The National Wildlife Federation said the decision “sets a dangerous precedent that threatens the urgent restoration of federal clean water protections nationwide.”
The Supreme Court has yet to issue its Sackett decision, which could force EPA to take another look at the rule.

Food insecurity on the rise
As food prices increased over 10% from December 2021 until December 2022, the share of adults reporting food insecurity rose from 20% to 24.6%, according to a new report released by the Urban Institute.
Food insecurity hit Hispanic and Black adults at a higher level, nearly double the increase when compared to white adults.
“Households experiencing very low food security not only report reductions in dietary quality and variety but also experience reduced food intake and skipped meals, presenting a more severe indicator of household hunger,” the report states.
Food banks continued to report strong needs as federal support decreased and food costs increased. Nearly one in six adults (about 16%) reported their households received charitable food in 2022, down from 17.4% in 2021. That also was down from the height of usage in 2020 at 19.7%, but well above the pre-pandemic rate in 2019 of 12.7%.
Producers exercise caution as interest rates roil farm country
Federal Reserve action to curb inflation is also having an impact on the business decisions of American producers, according to a panel of ag economy experts speaking Monday at the Agri-Pulse Ag and Food Policy Summit.
Interest rates have ticked higher over the last year, and media reports indicate another quarter-point hike could take place this week. After years of robust commodity prices and a solid farm economy, many producers have cash on hand, and they’re using it to avoid relying on changes in the market for credit.
“The one place that the high interest rates are really bothering (farmers) is their operating notes,” Joe Outlaw, a professor and extension economist with Texas A&M, said during a panel discussion. “The cost of (planting) crops is so much more across the board; not just fertilizer went up, but everything went up.”

Ben Barnes frames this as something he wants out there for the historical record and how it affected carter. He glosses over how this potentially led to the hostages spending more time as hostages while their families worried at home.
He says he wasn’t involved. Except he was involved since why else would he have continued the tour once he knew what his partner was doing? First meeting, perhaps, but not after they repeated it again and again. He was a participant.
Also, because he knew what his partner was doing after the first meeting, he could have informed the US government before subsequent meetings took place. Instead the damaging tour continued.
By waiting to to disclose this until the later years of his life he evaded criminal, civil, and professional liability. The historical impact of this revelation would have been more significant had he come clean at the time.

The bill would not let California extradite doctors who are facing charges in another state for providing abortion medication. It would also shield doctors from having to pay fines. And it would let California doctors sue anyone who tries to stop them from providing abortions.
Hell yes! That last part is great. It means doctors are less likely to be harassed since they can retaliate in court against the nutcases.

South Carolina Abortion Bill Would Impose Death Penalty For Terminating A Pregnancy

Republican lawmakers in South Carolina are debating whether to change a controversial bill that would make individuals who receive an abortion eligible for the death penalty.
The bill, which has been dubbed the South Carolina Prenatal Equal Protection Act of 2023, would “ensure that an unborn child who is a victim of homicide is afforded equal protection under the homicide laws of the state,” according to South Carolina General Assembly website.
The bill would also define a “person” as an “unborn child at every stage of development from fertilization until birth.”

If the eyebrow-raising piece of legislation is passed, those convicted of murder could face the death penalty or a minimum of 30 years in prison.

There are some exceptions for pregnant people and in cases of emergency
The bill will provide exceptions for pregnant people who have to receive an emergency abortion due to “the threat of imminent death or great bodily injury.” It also provides an exception if the procedure is needed to avert the death of a mother “when all reasonable alternatives to save the life of the unborn child were attempted or none were available,” the website adds.

Sadly, South Carolina’s Equal Protection Act does not provide any exceptions for victims of rape or incest.

With the dismantling of Roe V. Wade last year, proponents of the bill are now bracing themselves for more destruction. Rep. Nancy Mace of the first congressional district blasted Republican lawmakers for proposing the restrictive abortion plan.
“To see this debate go to the dark places, the dark edges, where it has gone on both sides of the aisle, has been deeply disturbing to me as a woman, as a female legislator, as a mom, and as a victim of rape,” Mace said, according to The Hill.
Since the fall of Roe, Republican states have been working overtime to place abortion limitations. 18 states have launched near or total bans on the procedure.
As of now, abortion remains constitutional in South Carolina, but Republican lawmakers are determined to change this.
Before the stringent ban went into effect, in 2021 the Food and Drug Administration relaxed some of the tight restrictions placed on one abortion pill called mifepristone, which can end a pregnancy that is less than 10 weeks along. Patients were initially required to pick up the medication at a certified hospital or clinic, but during the pandemic, the Biden Administration changed the protocol, allowing women in abortion-banned states to receive the pill by mail.

A New York Times review of financial documents and court records filed over the past year found that Mr. Jones has transferred millions of dollars in property, cash and business deals to family and friends, including to a new company run by his former personal trainer, all potentially out of reach of creditors. He has also spent heavily on luxuries, including $80,000 on a private jet, bodyguards and a rented villa while he was in Connecticut to testify at a trial last fall.
“If anybody thinks they’re shutting me down, they’re mistaken,” Mr. Jones said on his new podcast last month.
The families now face a stark reality. It is not clear whether they will ever collect a significant portion of the assets Mr. Jones has transferred. So their ability to get anything remotely close to the jury awards is inextricably tied to Mr. Jones’s capacity to make a living as the purveyor of lies — including that the shooting was a hoax, the parents were actors and the children did not really die — that ignited years of torment and threats against them.

Earlier this month, Mr. Jones offered to pay the families and his other creditors a total of $43 million over five years as part of a bankruptcy plan, which lawyers for the families immediately dismissed as laughable and riddled with financial holes. The judge ordered Mr. Jones to fill in the gaps in his financial disclosures by the end of the month.
But Mr. Jones’s continued obfuscation about his net worth has given him leverage over the families, who are also fighting an American bankruptcy system that makes the survival of businesses a priority and has so far given Mr. Jones an advantage in court.
Although Infowars has estimated revenues of some $70 million a year — hardly a mom-and-pop shop — Mr. Jones was able to file for Chapter 11 under the more lenient bankruptcy rules of the Small Business Reorganization Act, known as Subchapter V. The law first took effect in early 2020, but was soon broadened to assist small businesses struggling during the pandemic.
Unlike in a traditional Chapter 11 bankruptcy, Subchapter V gives creditors like the Sandy Hook families virtually no say in a restructuring plan, nor can they file a competing plan. They can challenge Mr. Jones’s approach, but an impasse in talks could result in liquidation of the company, putting them in line to collect a fraction of the damages.
A liquidation would end Infowars, but Mr. Jones would be free to start another company just like it.

Cruz urges Texas bar for careful consideration of Stanford graduates following campus protests

Sen. Ted Cruz (R-Texas) urged the Texas state bar to carefully consider the fitness of certain Stanford University law school graduates after a protest over a conservative judge’s speaking engagement on the campus.
Cruz in a letter to Texas officials said there is a “fundamental” question over whether the students who protested the appearance by Kyle Duncan, a circuit judge for the U.S. Court of Appeals for the Fifth Circuit, are “fit to practice law” in Texas.
“The idea that these future lawyers would find it acceptable to harass and insult a sitting judge boggles the mind, and seriously calls into question whether these students have the proper respect for the role of a judge, or the temperament to practice law,” he said in a Thursday letter to Texas Supreme Court Chief Justice Nathan Hecht and Augustin Rivera, the chair of the Texas Board of Law Examiners.
“Indeed, these students’ tantrum raises a fair question as to whether they can be trusted to dispassionately defend clients that might have ideological opinions different from their own,” Cruz wrote.
Duncan has visited Stanford Law School to participate in an event called “The Fifth Circuit in Conversation with the Supreme Court: COVID, Guns, and Twitter.”
Cruz said Duncan did not have the opportunity to “meaningfully speak” as he was “shouted down” by Stanford students.
Stanford’s student newspaper, The Stanford Daily, reported that audience members protested Duncan’s appearance before and during his lecture. The paper reported that opponents protesting Duncan’s appearance put up fliers throughout the campus arguing that Duncan has pushed for laws that have harmed women, immigrants and LGBTQ individuals.
Cruz said the protesters continuously interrupted Duncan, called him racist and yelled “crude sexual slurs.”

The Stanford Daily reported that the law school’s dean denounced the protest in an email to the school community, saying that what happened did not align with the institution’s “commitment to free speech.”

“The school is reviewing what transpired and will work to ensure protocols are in place so that disruptions of this nature do not occur again, and is committed to the conduct of events on terms that are consistent with the disruption policy and the principles of free speech and critical inquiry they support,” Dean Jenny Martinez said.
Cruz said the Texas board should “take particular care” for students graduating from Stanford law school in 2023, 2024 and 2025. He said these students should be forced to state in writing if they participated in the protest, and the Texas Supreme Court and the board should decide what the “proper remedy” should be.
“Texans deserve only the finest advocates as their counsel, and those that engage in screaming and name-calling to make their case, are far from the finest,” he said.

17 STATES HAVE NOW TRIED TO PASS BILLS THAT STRIP POWERS FROM REFORM-MINDED PROSECUTORS

In recent years, just under 40 bills have been introduced in various state legislatures that give local prosecutorial powers to state-level officials.
IN RECENT YEARS, a movement to elect reform-minded prosecutors across the country has won hard-fought victories across a handful of large cities. Now a growing backlash is taking on a new form: At least nine bills introduced this year across five states would strip power from democratically elected prosecutors. In many of the cases, more conservative legislatures are taking away power from local prosecutors in strongly liberal and Democratic cities and putting them in the hands of Republicans holding statewide offices.
Since the mid-2010s, dozens of cities across the country have elected prosecutors who enacted criminal justice reforms. Several have faced recall battles or other attempts to remove them from office. While at least one of the recall bids has succeeded, the efforts have largely failed. Facing losses at the ballot box, Republicans and police unions pushing a return to “tough-on-crime” policies are turning instead to state legislatures to advance their aims.
“Those committed to ensuring that only poor Black people get prosecuted, and that police officers who cause harm go free, are lashing out, trying to undermine the will of the voters by removing people who won’t go along with the old, out-of-touch criminal legal system,” said Jessica Brand, a progressive strategist who advises reformist prosecutors around the country. “This is a nation-wide assault on democracy.”
In January, the Local Solutions Support Center and the Public Rights Project, a nonprofit that advocates for civil rights and economic and environmental justice, released a report tallying bills introduced in legislative sessions between 2017 and 2022. The authors found that nearly 30 bills had been introduced in 16 states during that period.

“Although only five preemption laws have passed,” the report says, “this new trend is part of a larger movement by reactionary states to use preemption to thwart criminal justice reform and undermine the will of local constituents calling for this change.”

With at least nine additional bills have introduced this year, including one in a new state, Mississippi, totals rose to 37 bills in 17 states.

The federal system provides no legal protection for cities against state lawmakers who want to step in to stop a certain policy, leaving cities with progressive leanings at the mercy of conservative state officials.

In some cases, the power to recall an elected official serves a purpose — for instance, in North Carolina, which does not have a statute for recalling an elected official, an elected sheriff was indicted for attempted murder and refused to step down — but recalls can also be easily exploited for political purposes. In Florida, Republican Gov. Ron DeSantis removed an elected attorney, Andrew Warren, because he pledged not to prosecute women who sought abortions. This week, DeSantis moved to suspend another prosecutor over his handling of a criminal case.
Likewise, critics say that state legislatures are abusing their statutory authority by trying to rip power away from prosecutors.
Reformist prosecutors have come to office and undertaken policy changes like reducing or ending cash bail, declining to charge people in nonviolent drug possession cases, holding police accountable for misconduct, and addressing wrongful convictions. Conservative politicians, however, have painted these reformers as harbingers of lawlessness, blaming them for a spike in homicides — although that spike has also impacted areas with traditionally “tough-on-crime” prosecutors.

The new rash of legislative efforts to strip prosecutors of their power has sometimes come before reforms are even enacted. The district attorney in Polk County, Iowa, has been on the job for eight weeks, and state lawmakers are already trying to give her powers to the attorney general.

“All of these changes seem to be in direct response to policy preferences before anything has even happened,” said John Pfaff, a scholar of criminal justice at Fordham University School of Law. “This is clearly not a response to a failure of policy on the ground. This is a direct rebuke to voters saying what they want.”
REPUBLICAN LAWMAKERS IN Texas have introduced four bills that would prohibit prosecutors from declining to charge certain offenses or refusing to seek the death penalty in capital cases and would allow the attorney general to fine and seek removal of prosecutors who decline to pursue certain charges. One of the bills would prohibit elected prosecutors from adopting policies to limit criminal enforcement of laws related to voting and elections — laws that have become politicized following former President Donald Trump’s false claims of mass election fraud.
Another Texas bill would establish a council to monitor prosecutors and grant it the power to petition for prosecutors’ removal for “incompetency or misconduct.” The bills would apply to elected prosecutors across the state.
Georgia lawmakers have introduced two bills to take away power from prosecutors. One would make it easier to recall an elected prosecutor and another would prohibit prosecutors from using blanket policy guidelines, like declining to charge for drug possession or ending cash bail for nonviolent offenses. Another proposes an oversight commission for elected prosecutors appointed by the governor and grants the power to discipline, remove, and force elected prosecutors and solicitor generals to retire.
A bill in Iowa would give the attorney general power to prosecute any criminal charge without first receiving a request from the county attorney.
Mississippi is one place where conservative state-level officials are looking to rein in prosecutors from Democratic local officials, particularly in Hinds County, where majority-Black Jackson is located and Jody Owens holds the district attorney’s seat. One proposed bill would create a separate court system and police force for a district in Jackson, with prosecutors and public defenders appointed by the attorney general.
Jackson would become the only county in the state to not elect its own prosecutors and judges. The proposal has come under fire for giving white state officials the power to appoint officers and administer a separate judicial system for a heavily Black city. The bill passed the Mississippi State House last month largely along party lines.
Another bill in Missouri would allow the governor to appoint a special prosecutor to handle cases in any jurisdiction if the governor determines that “a threat to public safety and health” exists. The original version of the bill targeted the circuit attorney in St. Louis County, Kim Gardner, a reform-minded prosecutor who was elected in 2020 on promises to end cash bail and hold police accountable.
Gardner has been the target of attacks from high-ranking Republican officials, including Trump, and several bills targeting her office failed in previous sessions. The Missouri attorney general moved last week to remove Gardner from office over her handling of a case in which the defendant was released on bond and caused a car accident that led a teenage girl to have her legs amputated. Gardner’s office, however, has no power to assign or revoke bond.
Questions about the constitutionality of targeting one specific office led lawmakers to expand the bill to apply to any elected prosecutor in the state. (Police unions in Missouri are also backing another bill that would take power over the city’s police department away from a progressive mayor and give it instead to the state’s Republican governor.)
Of the at least nine bills introduced so far this year, bills in Mississippi and Missouri passed their state Houses, and one bill in Georgia has passed its state Senate. Last year, a bill in Virginia was voted down in committee, and the other bills have not yet moved toward a vote. (None of the bills’ sponsors responded to requests for comment.)
Part of the reason so few bills have become law is that even DAs who may not be part of the reform movement see these measures as a threat to their autonomy. Prosecutors are motivated to protect their own power and are willing to create coalition with ideological opponents to fight those who might seek to take it away. The county attorney’s association in Iowa, for instance, is opposing the bill there.
Conservative attacks on reform DAs tend to claim that their voting base are white progressives voting to impose lawlessness in Black communities, but that’s not the case, Pfaff said. A new paper he’s working on finds that reform-minded DAs generally find the most support in Black communities with high levels of gun violence. Lawmakers introducing bills to strip prosecutorial authority tend to represent suburban white voters.

“White liberal voters seem less open to reformers than Black communities are,” Pfaff said, but state legislatures are most influenced by white moderates and conservatives who hail from suburban and rural areas. “That’s part of what’s leading to this preemptive push you’re seeing in a lot of these red states.”
